1. Seller identity and scope

These terms and conditions of sale (the "Terms") govern all sales of products concluded on the website www.pilardi.fr between:

hereinafter "PILARDI" or "the Seller", on the one hand,

and any natural person acting for purposes which fall outside their commercial, industrial, craft, professional or agricultural activity, hereinafter "the Customer" or "the Consumer", on the other hand.

These Terms apply to the exclusion of all other conditions. They are supplemented by the following documents, available on the website and forming an integral part of them: the Shipping Policy, the Refund and Returns Policy, the Privacy Policy and the Legal Notice. In the event of any contradiction, these Terms prevail.

2. Acceptance of the Terms

Any order placed on the website implies full and unreserved acceptance of these Terms. The Customer acknowledges having read them before validating their order, validation of the order constituting express acceptance.

PILARDI reserves the right to amend these Terms at any time. The Terms applicable to an order are those in force on the date that order is placed.

3. Essential characteristics of the products

PILARDI offers decorative and collectible objects: mirrors, chess and backgammon boards, boxes, trays, table textiles, writing accessories and jewellery.

The products are made by hand, in very limited series or as one-of-a-kind pieces, using artisanal techniques such as khatam marquetry, miniature painting and Tazhib.

3.1 Artisanal variations

As each piece is shaped by hand, slight variations in tone, pattern, grain, dimensions and finish are inherent to this method of manufacture and constitute the very character of the object. Such variations do not constitute a lack of conformity within the meaning of article L.217-5 of the French Consumer Code.

The photographs and illustrations shown on the website are as faithful as possible, but perfect similarity between the product delivered and its representation cannot be guaranteed, in particular because of how colours are rendered on screen.

The essential characteristics of each product (materials, dimensions, finishes, provenance) appear on the corresponding product page, which the Customer is invited to consult before any purchase.

4. Prices and VAT

Prices are stated in euros (€) and exclude delivery costs. Any delivery costs are calculated according to the destination and displayed to the Customer before final validation of the order.

VAT not applicable – Article 293 B of the French General Tax Code. PILARDI benefits from the VAT-exempt small business scheme: no VAT is charged and the displayed price is the final price payable by the Customer.

The website may display prices in a currency other than the euro depending on the country or region selected. In that case, the amount actually charged is the one shown at the final payment step.

PILARDI reserves the right to amend its prices at any time. Products are invoiced on the basis of the rates in force at the time the order is recorded.

Any customs duties and import taxes applicable to certain destinations are addressed in article 9.5.

5. Ordering and order confirmation

The Customer places an order by following these steps:

  1. selection of the product(s) and addition to the basket;
  2. review of the basket contents;
  3. entry of contact details and delivery address;
  4. choice of delivery method and display of the corresponding costs;
  5. choice of payment method;
  6. a full order summary, allowing the Customer to identify and correct any error before validation;
  7. final validation of the order, which entails an obligation to pay.

The sale is definitively formed only after confirmation by PILARDI. A confirmation email summarising the order is sent to the Customer at the email address provided.

It is the Customer's responsibility to check the accuracy of the information supplied, in particular the delivery address. PILARDI cannot be held liable for an input error attributable to the Customer or its consequences, in particular any delay or impossibility of delivery.

PILARDI's computerised records, kept under reasonable security conditions, are considered proof of the communications and orders between the parties.

6. Product availability and cancellation

Product offers are valid for as long as they are visible on the website and while stocks last. As our pieces are produced in very limited quantities, some are available as a single example only.

Should a product prove genuinely unavailable after an order has been placed, PILARDI will inform the Customer as soon as possible and will refund in full all sums paid in respect of that product, no later than fourteen (14) days after payment.

PILARDI reserves the right to refuse or cancel any order in the event of a manifest error in price or description, suspected fraud, an order that is abnormal in view of usual quantities, or a previous unresolved dispute concerning payment of an earlier order. The Customer will be informed and refunded in full where applicable.

7. Payment

The price is payable in full on the day of the order. No order is dispatched before payment has actually been received.

7.1 Accepted payment methods

The payment methods offered at checkout are:

  • bank card;
  • PayPal;
  • Shop Pay.

Only the payment methods actually displayed at the payment step may be used.

7.2 Payment security

Bank card payments are processed by an authorised payment service provider over a secure connection, with strong customer authentication where required. Payment data is transmitted directly to the provider and is neither collected nor stored by PILARDI.

If payment authorisation is refused by the accredited bodies, or in the event of non-payment, the order is automatically cancelled.

8. Retention of title

The products remain the exclusive property of PILARDI until their price has been paid in full by the Customer.

This retention of title does not affect the transfer of risk, which is governed by article 9.4 below.

9. Delivery

9.1 Delivery destinations and preparation

PILARDI delivers to mainland France, the European Union, the United Kingdom, the United States and internationally.

Orders are prepared and dispatched from Paris within one (1) to two (2) business days after payment confirmation. Each piece is inspected and hand-packed before being handed to the carrier.

9.2 Delivery times

  • Mainland France — Colissimo, 2 to 3 business days from dispatch;
  • European Union — Colissimo International, 3 to 6 business days depending on destination;
  • United Kingdom — Colissimo International or equivalent tracked service, 3 to 7 business days depending on destination and customs processing;
  • United States — FedEx International Priority or equivalent tracked service, 2 to 5 business days depending on destination;
  • International (outside the European Union) — FedEx International Priority or equivalent tracked service, 2 to 7 business days depending on destination.

These times are provided by the carriers as estimates and run from dispatch. They may vary during peak periods, in the event of customs inspection, or in circumstances beyond the carrier's control.

In any event, and in accordance with article L.216-1 of the French Consumer Code, PILARDI delivers the product no later than thirty (30) days after conclusion of the contract, unless a different period has been expressly agreed with the Customer.

9.3 Delivery costs, tracking and insurance

  • France — free insured delivery on all orders;
  • European Union, United Kingdom, United States and international — costs calculated at checkout according to destination, parcel dimensions and available carrier options.

The exact delivery cost is always displayed before final validation of the order.

Every shipment is insured for the value of the order against loss or damage in transit. A tracking number is sent to the Customer by email as soon as the parcel is handed to the carrier.

9.4 Transfer of risk

In accordance with article L.216-4 of the French Consumer Code, the risk of loss or damage to the products passes to the Consumer at the moment when the Consumer, or a third party designated by them other than the carrier proposed by PILARDI, takes physical possession of the products.

9.5 Customs and import taxes

  • European Union — as orders are shipped from France, no customs duties or additional import charges are payable.
  • United States — orders are shipped Delivered Duty Paid (DDP): PILARDI covers customs duties and import formalities. The price shown at checkout is the final price; no customs charges or carrier handling fees will be requested on delivery.
  • United Kingdom and other destinations outside the European Union — import VAT, customs duties, local taxes and carrier handling fees are not included in our prices and remain payable by the Customer, unless expressly stated otherwise at checkout. These amounts are determined by the authorities of the destination country.

9.6 Delay, damaged or lost parcels

Where PILARDI fails to deliver on the date or by the expiry of the agreed period, the Customer may, in accordance with article L.216-6 of the French Consumer Code, require PILARDI to deliver within a reasonable additional period and, failing performance, terminate the contract by registered letter or in writing on another durable medium. Sums paid are then returned no later than fourteen (14) days following termination of the contract.

If the parcel arrives visibly damaged, or if the product is found to be damaged on arrival, the Customer is advised to record reservations with the carrier and to notify PILARDI within five (5) days at info@pilardi.fr, enclosing photographs of the parcel, the packaging and the product. This recommendation is intended to facilitate handling of the claim and does not restrict the statutory guarantees set out in article 14.

In the event of a parcel lost in transit, PILARDI will open an investigation with the carrier and implement the appropriate solution, without prejudice to the Consumer's rights.

10. Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Consumer has a period of fourteen (14) calendar days to exercise their right of withdrawal without having to give reasons or bear any penalty.

This period runs from the day on which the Consumer, or a third party designated by them other than the carrier, takes physical possession of the product. Where the order covers several products delivered separately, the period runs from receipt of the last product.

To exercise this right, the Consumer notifies their decision by means of an unambiguous statement, before expiry of the period:

The Consumer is asked to contact PILARDI before returning any item so that the return can be arranged under transport conditions suited to the fragility of the pieces. This request serves a practical purpose and does not condition the validity of the withdrawal.

11. Return procedure

The Consumer returns the product no later than fourteen (14) days after communicating their decision to withdraw.

To be eligible, the returned product must be:

  • unused and in its original condition;
  • complete, with all its accessories and documents where applicable (certificate of authenticity, artisan's signed card);
  • undamaged;
  • returned in its original packaging and suitably protected for return transport.

In accordance with article L.221-23 of the French Consumer Code, the Consumer may be held liable for any depreciation of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning. A proportionate deduction may then be applied to the refund.

The direct costs of returning the product are borne by the Consumer, except where the return results from an error by PILARDI, from a non-conforming or damaged product, or where the law provides otherwise.

12. Statutory exclusions from the right of withdrawal

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for, among others, contracts for the supply of goods made to the Consumer's specifications or clearly personalised.

This exclusion applies only to orders genuinely made to measure or personalised at the Consumer's request — for example an engraving, a monogram, or a piece commissioned to a specification. It is brought clearly to the Consumer's attention before any such order is validated.

Pieces offered for sale in our collections, although handmade and produced in limited quantities, are not regarded as personalised and therefore carry the full right of withdrawal.

13. Refunds

In the event of withdrawal, PILARDI refunds all sums paid, including the standard delivery costs initially charged, no later than fourteen (14) days from the date on which it is informed of the Consumer's decision, in accordance with article L.221-24 of the French Consumer Code.

PILARDI may defer the refund until the product has been recovered or until the Consumer has provided proof of dispatch, whichever occurs first.

Where the Consumer has expressly chosen a more expensive delivery method than the standard method offered, only the costs corresponding to the standard method are refunded.

The refund is made using the same means of payment as that used for the initial transaction, unless the Consumer expressly agrees to another means, and at no cost to them.

14. Statutory guarantees

PILARDI is liable for lack of conformity of the goods with the contract under the conditions of article L.217-3 et seq. of the French Consumer Code, and for hidden defects under the conditions provided for in articles 1641 et seq. of the French Civil Code.

14.1 Statutory guarantee of conformity

  • The Consumer has a period of two (2) years from delivery of the goods to obtain the benefit of the statutory guarantee of conformity where a lack of conformity appears.
  • The Consumer may choose between repair and replacement of the goods, subject to the cost conditions provided for in article L.217-12 of the French Consumer Code.
  • The Consumer is exempted from proving the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods, in accordance with article L.217-7 of the French Consumer Code.
  • Any goods repaired under the statutory guarantee of conformity benefit from a six (6) month extension of that guarantee.
  • The statutory guarantee of conformity applies independently of any commercial guarantee that may be granted.

14.2 Guarantee against hidden defects

The Consumer may decide to rely on the guarantee against hidden defects of the item sold within the meaning of article 1641 of the French Civil Code. In that case, they may choose between rescission of the sale and a reduction of the sale price, in accordance with article 1644 of the French Civil Code. Any action based on redhibitory defects must be brought within two (2) years of discovery of the defect, in accordance with article 1648 of the French Civil Code.

14.3 How to make a claim

Any claim under the statutory guarantees should be sent to info@pilardi.fr, together with the order number and, where applicable, photographs of the defect observed.

It is recalled that the artisanal variations described in article 3.1 do not constitute a lack of conformity.

15. Customer service and complaints

For any question, request for information or complaint concerning an order, the Customer may contact PILARDI:

PILARDI undertakes to acknowledge receipt of any complaint and to respond as soon as possible. Any complaint must first be addressed directly to customer service in order to seek an amicable solution.

16. Consumer mediation

In accordance with article L.612-1 of the French Consumer Code, every consumer has the right to free recourse to a consumer mediator with a view to the amicable resolution of a dispute with a trader. Such recourse presupposes that the Consumer has first attempted to resolve the dispute directly with PILARDI's customer service, under the conditions of article 15 of these Terms.

PILARDI is in the process of designating a consumer mediator listed by the French commission for the evaluation and control of consumer mediation (CECMC). In accordance with article L.616-1 of the French Consumer Code, the name, postal address and website of the designated mediator will be published in this article as soon as that designation takes effect.

In the meantime, a Consumer wishing to begin a mediation process may notify PILARDI at info@pilardi.fr. PILARDI undertakes to provide the mediator's contact details as soon as the designation is made, and not to obstruct the commencement of a mediation procedure.

Recourse to mediation is free of charge for the Consumer and is not a mandatory precondition to bringing proceedings before the competent courts.

17. Liability and force majeure

PILARDI is automatically liable to the Consumer for the proper performance of the obligations arising from the distance contract, in accordance with article L.221-15 of the French Consumer Code. It may however be released from all or part of its liability by proving that non-performance or improper performance of the contract is attributable either to the Consumer, or to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to a case of force majeure.

PILARDI cannot be held liable for non-performance or delay in performing its obligations resulting from a case of force majeure within the meaning of article 1218 of the French Civil Code, such as a natural disaster, fire, carrier strike, interruption of communication networks or a decision of the public authorities.

Nor can PILARDI be held liable for the use made of the products by the Customer, in particular where the Customer does not follow the care recommendations supplied with the piece. Our objects are decorative and collectible pieces: they are not intended for direct food use, nor for prolonged exposure to humidity or direct sunlight.

18. Intellectual property

All elements appearing on the website www.pilardi.fr — texts, photographs, images, illustrations, logos, trade marks, drawings, designs, graphic elements and layouts — are protected by intellectual property law and remain the exclusive property of PILARDI or its partners.

Any reproduction, representation, modification, adaptation or distribution, in whole or in part, without PILARDI's prior written authorisation is prohibited and constitutes an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

The sale of a product does not entail any transfer of intellectual property rights in the motifs, designs or savoir-faire it incorporates.

19. Personal data

Personal data collected in connection with an order is processed by PILARDI as data controller, for the purposes of order management, delivery, invoicing, customer service and, subject to the Customer's consent, sending commercial communications.

In accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 as amended, the Customer has rights of access, rectification, erasure, restriction, portability and objection, as well as the right to give directions concerning the fate of their data after death. These rights may be exercised at info@pilardi.fr.

The Customer also has the right to lodge a complaint with the French data protection authority (CNIL), 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.

20. Governing law and competent courts

These Terms and the resulting contracts of sale are governed by French law.

In accordance with the applicable European rules, a Consumer residing in another Member State of the European Union retains the benefit of the mandatory protective provisions of the law of their country of habitual residence.

In the event of a dispute, the Consumer may bring proceedings before, at their choice, any court having territorial jurisdiction under the French Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred.

21. Entry into force and amendments

These terms and conditions of sale are in force from 20 August 2026.

PILARDI reserves the right to amend them at any time in order to reflect changes in its offering or in the applicable regulations. The version applicable to an order is the one online on the day that order is placed.
